1. Agreement
By accessing or using Media Uploader, you agree to these Terms of Service and our Privacy Policy. If you use the service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not connect an account or use the service.
2. Eligibility and account authority
You must be legally capable of entering into these terms and meet the eligibility requirements of TikTok and applicable law. You may connect only a TikTok account you own or are expressly authorized to manage. You are responsible for maintaining the security of the local environment and for promptly revoking access if authorization is no longer appropriate.
3. The service
Media Uploader allows an authenticated creator to review prepared video content, edit a caption, choose privacy options provided by TikTok, review interaction and disclosure settings, explicitly confirm the exact video, and manually publish through TikTok’s Content Posting API. Features may be limited by the current TikTok environment, app audit status, account settings, API availability, and product safety rules.
The service does not promise unattended posting, continuous availability, public-post capability, a particular review outcome, or successful delivery of every post.
4. Creator control and confirmations
You must review the exact video and caption before publishing. Privacy is not selected on your behalf. Interaction controls begin off. You must provide accurate commercial-content disclosure and accept any required music or content confirmation. A Publish action is your instruction to transmit the selected content and settings to TikTok.
5. Your content and permissions
You retain ownership of content you lawfully own. You grant us a limited license to process, validate, transmit, and retain necessary evidence about your content solely to operate, secure, and support the service. You represent that you have all rights, licenses, consents, and permissions needed for the video, audio, music, people, brands, metadata, and claims in each post.
6. Acceptable use
You must not use Media Uploader to:
- publish illegal, infringing, deceptive, harmful, abusive, or unauthorized content;
- connect or impersonate an account without authority;
- bypass TikTok privacy choices, app review restrictions, rate limits, account settings, or safety gates;
- automate clicks or modify the service to enable unattended, bulk, or hidden posting;
- reuse stale consent or knowingly retry an ambiguous attempt without proper reconciliation;
- extract, expose, share, or misuse tokens, authorization codes, signed upload URLs, or other credentials;
- interfere with the service, its local storage, or third-party APIs; or
- violate TikTok’s terms, community guidelines, developer policies, or applicable law.
7. TikTok and third-party services
TikTok is an independent third-party service. Your TikTok use is governed by TikTok’s terms, policies, and decisions. TikTok may restrict scopes, privacy choices, duration, accounts, posts, or API access. Media Uploader is not endorsed by, sponsored by, or affiliated with TikTok, and we cannot control TikTok availability or review decisions.
8. Safety records and recovery
To prevent accidental duplicate publishing, the service may preserve content fingerprints, publish identifiers, progress, results, attempt reservations, and completion or recovery audit records. Failed or ambiguous attempts may remain blocked until evidence supports an explicit recovery decision. You agree not to delete or alter unresolved records in a way that could cause an unsafe retry.
9. Suspension and termination
You may stop using the service and revoke TikTok access at any time. We may suspend or terminate access when reasonably necessary to protect accounts, comply with law or platform requirements, investigate misuse, or prevent harm. Provisions that by their nature should survive—including content responsibility, disclaimers, liability limits, and dispute terms—will survive termination.
10. Availability and changes
We may change, limit, suspend, or discontinue features. TikTok API changes may require reauthorization or make a workflow temporarily unavailable. We do not guarantee that the service will be error-free, uninterrupted, compatible with every file, or approved for production publishing.
11. Disclaimers
To the maximum extent permitted by law, Media Uploader is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or a specific publishing or review result. Nothing in these terms excludes a warranty that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of content, account access, profits, goodwill, or data arising from the service, TikTok, an unauthorized account, or a publishing decision. Any liability that cannot be excluded is limited to the minimum amount permitted by applicable law.
13. Indemnity
Where permitted by law, you agree to defend and indemnify the service operator against claims, losses, and expenses arising from your content, your connected account, your violation of these terms or third-party rights, or your misuse of the service.
14. Applicable law and disputes
These terms are governed by the laws that apply to the service operator, without overriding mandatory consumer protections that apply where you live. Before filing a formal claim, please contact us so we can attempt to resolve the issue informally. Courts with lawful jurisdiction may hear unresolved disputes.
15. Changes to these terms
We may update these terms as the product, law, or TikTok requirements change. The updated date will be posted here. Continued use after an update constitutes acceptance where permitted by law; we will provide additional notice where required.
16. Contact
Questions about these terms may be sent to media@maxxi.org. Please do not send credentials, access tokens, or unpublished media by email.
